These terms and conditions apply to the Efficio: AI Productivity Coach app (referred to as "Application") for mobile devices, created by Avid Minds LLC (referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

2. Description of Service

Efficio: AI Productivity Coach is designed to help users enhance their productivity through AI-powered coaching and guidance. The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible.

The Service Provider reserves the right to modify the Application or charge for their services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you.

3. Intellectual Property Rights

The following actions are strictly prohibited:

• Unauthorized copying or modification of the Application
• Copying any part of the Application or our trademarks
• Attempting to extract the source code of the Application
• Translating the Application into other languages without permission
• Creating derivative versions of the Application

All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the exclusive property of the Service Provider.

4. User Responsibilities

As a user of the Application, you are responsible for:

• Maintaining the security of your phone and access to the Application
• Using the Application in accordance with these terms
• Ensuring your device meets the necessary requirements

Security Warning: The Service Provider strongly advises against jailbreaking or rooting your phone, as such actions could expose your device to malware, viruses, and malicious programs, compromise security features, and may result in the Application not functioning correctly.

6. Internet Connection Requirements

Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or exhausted data allowance.

7. Data Charges and Fees

When using the Application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply. You may incur charges including:

• Data usage charges during connection to the Application
• Third-party charges
• Roaming data charges when used outside your home territory

By using the Application, you accept responsibility for any such charges. If you are not the bill payer for the device, ensure you have obtained permission from the bill payer.

8. Device Responsibility

The Service Provider cannot assume responsibility for certain aspects of your device usage. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you cannot access the Service, the Service Provider cannot be held responsible.

9. Service Availability and Updates

The Service Provider may update the Application periodically. The Application is currently available per the requirements for your operating system, which may change over time.

• You will need to download updates to continue using the Application
• The Service Provider does not guarantee constant updates for all devices
• You agree to accept updates when offered

10. Limitation of Liability

The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the Application.

11. Termination

The Service Provider may terminate use of the Application at any time without providing termination notice. Upon termination:

• The rights and licenses granted to you in these terms will end
• You must cease using the Application
• You must delete the Application from your device if necessary
